H1-B Visa

 

Description

H-1B visa is a work visa generally used by professionals to be employed in a "specialty occupation."

Requirements

    The two main requirements are that
  1. The candidate for the job has a bachelor's degree or equivalent, and
  2. The job requires the bachelor's degree or equivalent.

    Some examples of specialty occupations include computer professionals, architects, engineers, accountants, and business analysts. For each year of university the candidate does not have, three years of work experience must be demonstrated to show that the candidate has the equivalent of a bachelor's degree.

Family members

The spouse and minor, dependent children of the H-1B holder may be entitled to H-4 dependent visas valid for the same amount of time as the H-1B holder. The spouse and minor, dependent children of the H-1B holder may not be employed.

Duration of Visa

H-1B visa is valid for three years, and can be extended for an additional three years, for a total of six years in H-1B status. Extensions in yearly increments may be available for some H-1B visa holders. Please contact our office to discuss if this is applicable to your situation.
