Description
An E-1 "Treaty Trader" visa is
for a person who is coming to the U.S. to
carry on substantial trade between the U.S.
and a country with which the U.S. has the
requisite treaty.
Requirements
- The existence of the required
treaty between the U.S. and the
country of nationality.
- The individual or company
must have the nationality
of the treaty country
- Active trade between
the U.S. and the
treaty country whose nationality
the E-1
Treaty Trader holds.
- The trade must
be "substantial." Whether
trade is substantial
may be determined
from the number
of transactions
and the amount
of money involved.
- The trade
must
be principally between
the U.S.
and the treaty
country.
This requirement
is met
if at
least 50% of the
trade
is with the treaty
country
- The
position that
the E-1 nonimmigrant
holds in the
U.S. must
be an executive
or supervisory position,
or a position
that requires
skills essential
to the company.
