E-1 Visa

Description

An E-1 "Treaty Trader" visa is for a person who is coming to the U.S. to carry on substantial trade between the U.S. and a country with which the U.S. has the requisite treaty.


Requirements

  1. The existence of the required treaty between the U.S. and the country of nationality.
  2. The individual or company must have the nationality of the treaty country
  3. Active trade between the U.S. and the treaty country whose nationality the E-1 Treaty Trader holds.
  4. The trade must be "substantial." Whether trade is substantial may be determined from the number of transactions and the amount of money involved.
  5. The trade must be principally between the U.S. and the treaty country. This requirement is met if at least 50% of the trade is with the treaty country
  6. The position that the E-1 nonimmigrant holds in the U.S. must be an executive or supervisory position, or a position that requires skills essential to the company.
